Stoplight Traffic Cameras: Who is really responsible for the fine?
Everyone has seen or heard about the cameras taking photos (or video) in cars that run red lights so that later you can receive a fine of Nice in the mail but, how legal is this practice? If let a family member or friend who borrowed my car and being dragged, it is your responsibility to pay the traffic ticket … Right? But what if you run a red light and gives me a ticket in the mail, am I legally obligated to pay? What if a rental car? What do you think of this?
For the statutes in each state, the owner of the vehicle that is photographed is responsible for paying the fine. That person can then take civil action against the driver for payment of the fine, if they can prove that the driver was the one who says it was, and not themselves. For leased vehicles, which varies from jurisdiction to jurisdiction, but the makes most tenant / assignee of the lease charge. That means the person who actually rented the car.
